Ruperea de Europa: România în derivă

S-au împlinit, ieri, 23 de ani de la cererea oficială de aderare a României la Uniunea Europeană. Momentul a fost marcat de conducerea PSD prin cel mai grav atac la adresa statului de drept şi a democraţiei din 1990 încoace. Drept urmare, România riscă să nu mai îndeplinească primul dintre Criteriile de la Copenhaga, pe care statele candidate trebuie să le respecte: stabilitatea instituţiilor ce garantează democraţia, statul de drept şi drepturile omului.

Cererea din 1995 de aderare la UE a fost însoţită de „Strategia naţională de pregătire a aderării României la Uniunea Europeană”, document intrat în istorie ca „Declaraţia de la Snagov”, semnată de toţi liderii partidelor parlamentare, de preşedinţii celor două Camere ale Parlamentului şi de Preşedintele ţării. Consensul de la Snagov, parafat în 21 iunie 1995, a fost un moment unic în perioada post-comunistă de depăşire a limitelor şi adversităţilor politice în vederea asigurării unui destin european pentru România.

Oglindă dezolantă peste timp: în 21 iunie 2018, sentinţa în primă instanţă a liderului PSD, Dragnea Nicolae-Liviu, a declanşat un asalt paroxistic al principalului partid de guvernare la adresa principiului constituţional al independenţei Justiţiei, consacrat de art. 124 din legea fundamentală („Judecătorii sunt independenţi şi se supun numai legii”) şi împotriva principiului egalităţii cetăţenilor în faţa legii, stipulat în art. 16 din Constituţie („Nimeni nu este mai presus de lege”). După cum reiterează Asociaţia Magistraţilor din România, „este inacceptabil ca persoane ce ocupă funcţii de conducere la vârful statului român să îşi folosească influenţa pentru a pune presiune asupra judecătorilor chemaţi să soluţioneze cauze în care aceştia sunt judecaţi”.

Din păcate, realitatea acestor zile ne arată cât de departe suntem de obiectivul esenţial al Acordului de Asociere a României la UE – document semnat în 1993 şi intrat în vigoare la 1 februarie 1995: „crearea cadrului instituţional necesar pentru stabilirea unui puternic dialog politic” era primul dintre obiectivele etapei pre-aderare. Este pe cale să fie spulberată şi ultima fărâmă de stabilitate a instituțiilor care garantează democrația, statul de drept şi drepturile omului – acesta fiind primul dintre criteriile de eligibilitate ale UE, aşa cum au fost definite de Consiliul European de la Copenhaga din iunie 1993. Este condiţia de bază pentru a accede la statutul de ţară membră a UE, înainte de a avea o economie de piață funcțională.

De altfel, România e pe cale să încalce, prin dictatul mafiei politice, art. 2 din Tratatul privind Uniunea Europeană, care specifică faptul că UE „se întemeiază pe valorile respectării demnității umane, libertății, democrației, egalității, statului de drept, precum și pe respectarea drepturilor omului, inclusiv a drepturilor persoanelor care aparțin minorităților. Aceste valori sunt comune statelor membre într-o societate caracterizată prin pluralism, nediscriminare, toleranță, justiție, solidaritate”.

Reprimarea brutală a demonstraţiilor de stradă, culminând cu agresarea filosofului centenar Mihai Şora, presiunile făţişe asupra Justiţiei, invocarea posibilităţii de nerespectare a procedurilor parlamentare în materie de adoptare a legislaţiei, ameninţarea de a „zdrobi” instituţiile statului de drept care mai rezistă asaltului autoritarist – sunt doar cele mai recente involuţii dintr-o serie neagră de destructurare a separaţiei şi echilibrului puterilor în stat, în beneficiul lui Dragnea Nicolae-Liviu şi a camarilei sale. Intimidarea presei libere şi a societăţii civile, refuzul oricărui dialog cu opoziţia şi protestatarii, compromiterea independenţei şi legitimităţii unor instituţii fundamentale, precum Curtea Constituţională, ameninţările personale, adresate în stil mafiot, unor reprezentanţi de instituţii ori partide – toate acestea sunt motive în plus de alertă.

România este ruptă brutal, în aceste zile, de standardele europene în materie democratică. Se impune dezbaterea de urgenţă a acestei grave situaţii la Consiliul European din 28-29 iunie şi în Parlamentul European, în sesiunea plenară din 2-5 iulie.

Fără sprijinul urgent al partenerilor euroatlantici, societatea civilă şi opoziţia politică vor fi aduse curând la tăcere în cel mai stalinist mod cu putinţă.

Acum câteva luni, prim-vicepreşedintele Comisiei Europene, Frans Timmermans, implora la Bucureşti: „Este ca atunci când alergi la un maraton şi suntem acum pe ultima sută de metri. Mesajul meu a fost astăzi: continuaţi să alergaţi, dar nu în direcţia greşită, ci spre linia de sosire, căci aproape aţi ajuns. Mai sunt doar câteva recomandări ale Comisiei pe care trebuie să le îndepliniţi. Dar nu vă opriţi, nu bateţi pasul pe loc şi, mai ales, pentru numele lui Dumnezeu, nu alergaţi în cealaltă direcţie”.

Între timp, rezistenţa magistraţilor – cu suportul larg al societăţii româneşti în faţa presiunilor unor politicieni disperaţi – a determinat intrarea în faza terminală a asaltului anti-democratic, cu riscul iminent al prăbuşirii tuturor eforturilor postcomuniste de construire a unui stat de drept şi a unei societăţi bazate pe drepturile omului.
